GROUPS & EVENTS
TERMS & CONDITIONS

Malamala Beach Club is owned and operated by South Sea Cruises Pte Limited. All references to Malamala Beach Club are also references to South Sea Cruises Pte Limited.

 

PRICING
• All prices are in Fijian dollars and include all applicable government taxes. Quotes are valid for 30 days and are subject to availability at the time of confirmation.

 

CONDITIONS OF CARRIAGE AND/OR CHARTER
• All confirmed bookings are subject to wind, tide, and weather conditions and are operated at the sole discretion of South Sea Cruises Pte Limited in the interests of the safety and welfare of the passengers, vessel, and crew.
• South Sea Cruises Pte Limited reserves the absolute right to alter prices, add a fuel surcharge, cancel a departure, operate any vessel on any cruise, to decline to accept or retain any person(s) on any cruise, shore excursion, or other cruise activity, to cancel, amend or reschedule any cruise vessel, schedule or itinerary, shore excursion, island activities or any other service for any reason which South Sea Cruises Pte Limited in its absolute and sole discretion considers desirable or necessary in the interests of operational necessity and/ or passengers safety and/or wellbeing.
• Arrival and departure times at ports and various places of call are provided as a guide only and in this regard, no warranty, condition, or guarantee, express or implied, is given or intended.
• Due to unexpected weather conditions, access to the jetty at Malamala Beach Club may be restricted, and the option of tendering guests ashore in smaller vessels may be utilized as an alternative.


EXCLUSIVE USE OF MALAMALA BEACH CLUB
• Quotes for exclusive use of Malamala Beach Club are based on a minimum Food & Beverage (F&B) spend. Groups that don’t commit to the minimum F&B spend amount will be required to pay the minimum F&B spend amount regardless of consumption.
• Groups of over 350 guests can be considered/ quoted depending on the actual requirements of the group. Additional costs may apply should the island require extra preparation and set up time pre- and/or post the charter date due to the larger-than-normal numbers. Additional costs may also be incurred to cover the hireage of any extra items needed to accommodate the larger group.
• Small Group Exclusive Use Supplement. Exclusive-use charters of Malamala Beach Club are subject to an Exclusive Use Supplement of FJD 10,000 for smaller private groups (groups of 150 persons or less). This supplement applies in addition to the applicable vessel charter fee and minimum food and beverage spend and reflects the private reservation of the entire island venue for the exclusive enjoyment of the charter group.
• All bookings on an exclusive use basis, whereby 75+ guests are travelling, require exclusive return vessel transfers to be booked with South Sea Cruises as per the rates listed.
• All bookings for exclusive use of Malamala Beach Club or The Venue where the group number does not exceed 75 guests may arrange vessel transfers with an operator other than South Sea Cruises.


SHARED USE OF MALAMALA BEACH CLUB
• Shared use bookings are accepted for groups of a maximum of 100 guests. Groups of 100+ guests must take the island on an exclusive basis.
• All bookings on a shared use basis, whereby less than 100 guests are travelling, will travel on the South Sea Cruises scheduled vessel services to Malamala Beach Club departing at 9.00 am daily or 12.00 pm (Wed - Sun) and returning to Port Denarau at 4.45 pm as per the rates listed.
• All return vessel transfer rates listed are from Port Denarau to/from Malamala Beach Club and Momi Bay to/from Malamala Beach Club to/from Port Denarau undertaken by South Sea Cruises. Quotes and/or services to/from other destinations can be provided upon request.
• Ground transfers to/from Port Denarau are not included in the rates provided. Ground transfers can be quoted separately.
• Malamala Beach Club welcomes children; children aged 3+ years pay adult rates.

 

WATERSPORTS ACTIVITIES
• Customers are required to follow all operating guidelines and safety procedures issued by Malamala Beach Club, whether verbally or in writing.
• All customers will be required to sign an indemnity form for water sports activities. Children under the age of 16 years must have an adult consent and indemnity signed by a parent or adult responsible for their care.


TRAVEL INSURANCE POLICY
• There are no medical facilities located at Malamala Beach Club other than basic first aid equipment, including a defibrillator. If any serious medical problem arises, the person(s) needing attention will need to return to Nadi and/or return home for further medical care at their own cost. It’s also important to note that sea and weather conditions can prevent or disrupt confirmed travel or events. It is therefore an essential condition when travelling with South Sea Cruises Pte Limited that all customers have a valid travel insurance policy in place before traveling to Malamala Beach Club.

 

PAYMENT TERMS
• Upon confirming a booking, a non-refundable deposit amounting to 25% of the total booking value is due within 14 days of invoice.
• The remainder of the full payment of the return vessel transfers and committed F&B options is required 60 days before travel.
• Bookings made within 60 days must be paid in full at the time of confirmation. Full payment is not required 60 days prior for groups of fewer than 25 pax using an agent with an approved credit account with South Sea Cruises/Malamala Beach Club.
• Payments made by International debit/credit cards are subject to a 2.5-3% non-refundable administration fee.
• Expenditure incurred at Malamala Beach Club during an event, which is over and above the prepaid F&B options, is required to be paid before departure from the island unless the booking agent has an approved credit account with South Sea Cruises/Malamala Beach Club.

 

AMENDMENTS & CANCELLATIONS
• An amendment fee of FJD$250 will be charged for any amendments made to the booking within 60 days prior to the travel date. If, however, the amendment is a change of date only with a similar value, then South Sea Cruises Pte Limited, at its discretion, may waive the amendment fee.
• All cancellations must be in writing to South Sea Cruises Pte Limited/Malamala Beach Club and the timing shall be based on the day of receipt of such notification by South Seas Cruises Pte Limited.
• Cancellation terms are as follows;

  • Outside 60 days - Forfeit of deposit (unless transferring to a new date at the same time).

  • 31 to 60 days - Forfeit 60% of the applicable booking.

  • 0 to 30 days - Forfeit 100% of applicable booking

• Should inclement weather result in the cancellation of the event, both parties must be in agreement to the cancellation, then one of the following options will be offered – an alternative day cruise/venue of a comparable product and/or value, the total value of the agreement will be held in credit to be used at a later date or a full refund will be provided to the Customer. The Beach Club reserves the right to make this decision and to do so with limited notice.
• Any refunds issued under this Agreement will be processed using the applicable currency exchange rate on the date the refund is made. The Client acknowledges and agrees that, due to fluctuations in exchange rates and any applicable bank or transaction fees, the refunded amount received may differ from the original amount paid. The Company shall not be held liable for any such variations in refunded amounts resulting from currency exchange movements or financial institution charges.


FORCE MAJEURE
• Neither party shall be held liable or responsible to the other, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from circumstances beyond the reasonable control of the affected party, including but not limited to: acts of God, fire, flood, earthquake, storm, cyclone, hurricane, explosion, pandemic, epidemic, government order or regulation, war, terrorism, civil disturbance, industrial dispute, labour shortage, or any other event beyond the parties’ reasonable control. The affected party shall notify promptly the other in writing of becoming aware of such an event and shall use all reasonable efforts to mitigate its effects.
If a Force Majeure event prevents or substantially hinders the performance of the event:

a) Both parties shall, in good faith, agree on an alternative date for the event within twelve (12) months of the original date, subject to availability.
b) If rescheduling is not possible, South Sea Cruises Pte Limited may, at its discretion, either:

• Provide a full credit of all payments made to be used within twelve (12) months; or
• Provide a refund of amounts paid, less any nonrecoverable costs reasonably incurred by South Sea Cruises Pte Limited in preparation for the event.

 

RATE VALIDITY
• Rates are valid for travel until 31 March 2027. Rates for travel beyond these dates are subject to
a 5% increase until such time as Malamala Beach Club issues confirmed rates for the following April – March period.
• Due to the volatility of global fuel prices, the Beach Club reserves the right to apply a fuel surcharge to vessel transfers and/or related services under this Agreement. Any such surcharge will only be applied in the event of a material increase in fuel costs between the date of this Agreement and the event date. The surcharge, if applicable, will be advised to the Customer in writing promptly following any relevant increase in fuel costs and will be payable as part of the final balance. The Beach Club agrees to act reasonably and provide supporting justification for any surcharge applied.
